1. Acceptance of Terms

By accessing or using DiviCharts ("the Service"), operated at divicharts.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

DiviCharts provides dividend stock analytics, valuation charts, fair value estimates, and related financial data visualization tools. The Service is intended for informational and educational purposes only.

3. Not Financial Advice

DiviCharts does not provide financial, investment, tax, or legal advice. All data, charts, fair value estimates, DiviScores, valuation verdicts, and projections are mathematical models based on historical data and publicly available information. They should not be interpreted as buy, sell, or hold recommendations.

You acknowledge that:

• Past performance is not indicative of future results.
• All investment decisions are made at your own risk.
• You should consult a licensed financial advisor before making investment decisions.
• We are not a registered investment advisor, broker-dealer, or financial planner.

4. Accounts

To access certain features, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use.

5. Free Trial

New users receive a 7-day free trial with access to 5 demo tickers (MSFT, AAPL, KO, PEP, WMT). No credit card is required. After the trial expires, continued access requires a paid subscription.

6. Subscriptions & Billing

Paid subscriptions are billed through Stripe on a monthly or annual basis. By subscribing, you authorize recurring charges to your payment method.

• Cancellation: You may cancel at any time. Access continues until the end of the current billing period.
• Refunds: We offer a 30-day money-back guarantee from the date of your first payment. Refund requests after 30 days are handled on a case-by-case basis.
• Price Changes: We reserve the right to change pricing with 30 days' notice. Existing subscribers are grandfathered at their current rate until their next renewal after the notice period.

7. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically download data from the Service.
• Reverse-engineer, decompile, or attempt to extract source code.
• Redistribute, resell, or sublicense DiviCharts data or charts without written permission.
• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use automated tools (bots, scripts) to access the Service beyond normal usage patterns.

8. Intellectual Property

All content, design, code, charts, and branding on DiviCharts are the intellectual property of DiviCharts and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Data Accuracy Disclaimer

While we strive for accuracy, financial data is sourced from third-party providers and may contain errors, omissions, or delays. We do not guarantee the accuracy, completeness, or timeliness of any data displayed on the Service. You use all data at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, DiviCharts and its operators shall not be liable for:

• Any investment losses or financial damages resulting from use of the Service.
• Indirect, incidental, special, consequential, or punitive damages.
• Service interruptions, data loss, or security breaches beyond our reasonable control.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DiviCharts, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state where the operator resides, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration or the competent courts of the operator's jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the website at least 14 days before taking effect. Continued use after changes constitutes acceptance.
